NexGen Comfort Services LLC will be collecting opt-in verbally from their customers. The customers will be able to opt in to receive messages either in person at their physical location, or over a phone call if the customer calls. When a customer is registered for the first time, they are asked to provide the phone number, and staff is trained to ask If the customer would like to opt in to SMS-based billing notifications, appointment reminders, dispatch notifications and job completion surveys. They will be verbally informed that “Message and data rates may apply”, “Message frequency may vary”, and they can “text HELP for support or more information and STOP to unsubscribe at any time and no further messages will be sent.” They will also be informed that their phone number will not be shared with third parties for marketing or promotional purposes.
Terms of Service
These Terms of Service (“Terms”) govern the services provided by NexGen Comfort Services LLC, a heating and air conditioning service company located in Texas (“Company”, “we”, or “us”). By requesting or receiving services from us, you (“Customer” or “you”) agree to these Terms.
1. Services Provided
We provide in-person heating and air conditioning services, including diagnostics, repairs, and equipment installations. Services are performed at customer premises within the state of Texas.
2. Scheduling and Appointments
Customers may schedule appointments by calling or texting our office. While we strive to be punctual, appointment times are approximate and subject to change due to unforeseen circumstances or prior service delays.
3. Payments
Payment is accepted via phone, web link or in person, before or after services are rendered. We accept credit cards, checks, and other common forms of payment.
4. Fees and Refunds
All diagnostic fees are non-refundable. Service charges and labor fees are due as agreed at the time of service. Refunds, if applicable, are issued at the discretion of the Company.
5. Warranties
We provide a 30-day labor warranty on all repairs. For equipment installations, a standard 1-year labor warranty applies. Manufacturer warranties for equipment may vary and are separate from our labor warranty.
6. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our maximum liability is limited to the amount paid for the specific service in question.
7. Governing Law
These Terms are governed by the laws of the State of Texas. Any disputes will be handled in the appropriate courts located within the State of Texas.
8. Acceptance of Terms
By scheduling and accepting services from us, you acknowledge that you have read, understood, and agreed to these Terms of Service.
