These Terms of Service (“Terms”) govern the services provided by NexGen Comfort Services LLC, a heating and air conditioning service company located in Texas (“Company,” “NexGen,” “we,” or “us”), and your use of our website, nexgencomfortservices.com. By requesting or receiving services from us or using our website, you (“Customer” or “you”) agree to these Terms.

1. Services provided

We provide in-person heating and air conditioning services, including diagnostics, repairs, maintenance, duct cleaning, and equipment installations. Services are performed at customer premises within the state of Texas.

2. Online quotes and estimates

Instant quotes and estimates from our website are based on the information you provide and are for planning purposes only. They are not a final price or an offer. Your final price is confirmed in a written proposal or invoice after we assess your home and equipment, and only a proposal you accept is binding.

3. Scheduling and appointments

Customers may schedule appointments by calling or texting our office or through our website. While we strive to be punctual, appointment times are approximate and subject to change due to unforeseen circumstances or prior service delays. You agree to provide safe access to the equipment and work areas, and to tell us about any known hazards.

4. Payments

Payment is accepted via phone, web link, or in person, before or after services are rendered. We accept credit cards, checks, and other common forms of payment. Card payments are processed by our third-party payment processors. If you choose financing, your financing agreement is with the lender and is governed by the lender’s terms.

5. Fees and refunds

All diagnostic fees are non-refundable. Service charges and labor fees are due as agreed at the time of service. Refunds, if applicable, are issued at the discretion of the Company.

6. Warranties

We provide a 30-day labor warranty on all repairs. For equipment installations, a standard 1-year labor warranty applies. If your written proposal, invoice, or membership agreement states a different warranty, that document controls. Manufacturer warranties for equipment may vary and are separate from our labor warranty. Work performed under a home warranty work order is covered by that home warranty company’s terms.

7. Comfort Plan memberships

Comfort Plan memberships are governed by the Membership Agreement you accept when you enroll, which includes pricing, billing, renewal, and cancellation terms. If the Membership Agreement and these Terms conflict, the Membership Agreement controls for your membership.

8. Calls, emails, and text messages

By giving us your contact information, you agree that we may contact you about your service requests, appointments, estimates, invoices, and account. If you opt in to text messages, our Text Messaging Policy applies: message frequency varies, message and data rates may apply, reply STOP to opt out and HELP for help. Consent to receive text messages is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.

9. Use of our website

You agree to provide accurate information and not to misuse our website, including by interfering with its operation, attempting to gain unauthorized access, or submitting information on behalf of someone else without permission. The content of this website, including text, graphics, and logos, belongs to NexGen or its licensors. Links to other websites are provided for convenience; we are not responsible for their content or practices.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our maximum liability is limited to the amount paid for the specific service in question. Our website is provided “as is” without warranties of any kind. Nothing in these Terms limits any rights you have under Texas law that cannot be waived.

Our Privacy Policy explains how we collect, use, and protect your information.

12. Governing law

These Terms are governed by the laws of the State of Texas. Any disputes will be handled in the appropriate courts located within the State of Texas.

13. Changes to these Terms

We may update these Terms from time to time. The version posted on this page, with its “Last updated” date, applies to services requested after that date.

14. Acceptance of Terms

By scheduling and accepting services from us, you acknowledge that you have read, understood, and agreed to these Terms of Service.
